Spending More Time with Your Children: A Look at Post-Divorce Timeshare Modifications

Want to spend more time with your child following your divorce? You may be in luck. Often, a court's ruling on child custody or timeshare can be challenged and successfully modified. To succeed, you typically must show that circumstances have changed to the extent that a custody modification is now justified (modifications to custody are generally more difficult to obtain than modifications to timeshare). For example, you may have a new work schedule that allows you to spend more time with your children; you may have moved closer to where the other parent lives; or the child himself may request to spend more time with you.

Channel surf on a weekday afternoon and you will likely come across a variety of "real world" talk shows. These talk shows distinguish themselves by featuring provocative issues such as domestic violence and adultery. One issue that afternoon talk shows are particularly keen about featuring is paternity tests. From Jerry Springer to Maury Povich and beyond, the talk shows continually have segments where the identity of a child's father is in doubt and must be determined. In a "reality" television "case," several men usually take a paternity test and the results are then dramatically revealed in the final five minutes of the show.

International Child Abduction

Feinberg & Waller, APC is pleased to report a recent win in a very complex, international Hague Convention family law battle. The case involved the parents of a young child who, up until her abrupt removal by her mother had lived in France with both parents for over two years. The mother took the child to the United States and, it was argued, wrongfully retained the child in the United States in contravention of the Hague Convention, an international treaty generally designed to provide rules on where child custody disputes are to be determined. It took father roughly fourteen months to locate his daughter so as to be able to bring the proceedings for her recovery in the Los Angeles Superior Court.

Children of divorce sometimes have it hard: One minute, they may be living in a happy family with two supportive parents. The next minute, their parents are screaming at one another and filing for divorce. Children find this situation very frightening. They may feel that they must choose one parent over the other. Some children try to be neutral and support both parents. Some children wish they could leave both parents behind and live with a relative or close friend instead. Some children feel they are to blame for their parents' problems while others see themselves as their parents' caretakers, and they try to "fix" things for their parents. As might be imagined, this is a very, very difficult situation for children to be in, and we should not expect them to make these decisions.

The custody issues surrounding the children of deceased pop star Michael Jackson were prominent topics this past week in Los Angeles as national and international news media sought family law analysis and commentary on the Michael Jackson custody situation. Australian Man Accused of Throwing Daughter to Her Death

The Associated Press reported this morning that a Melbourne, Australia man was accused of throwing his four-year old daughter to her death off a 190 foot (58 meter) eight-lane freeway bridge over the Yarra river in Melbourne. In a moment that can only be described as sheer insanity the man apparently unexpectedly stopped his SUV on the West Gate Bridge shortly after 9:00 am in the middle of rush hour. Stunned commuters phoned police to report seeing the man drop his child off the bridge. The police pulled the child from the river about ten minutes later, nearly dead. She was rushed to a nearby hospital where she died approximately four hours later.
