Do U.S. Laws Apply?

Needless to say, other countries may have dramatically different child custody laws than the United States. One factor that may play a critical role is the child’s birthplace. Was the child born in the United States, or a different country? Of course, there are many other factors, not the least of which is whether an amicable resolution is possible, or if one parent has taken the child to another country or threatened to do so, which is considered parental abduction.

In these cases, the legal process is dictated by the Hague Convention, assuming the country in question has signed the Hague Convention. The Hague Convention is a treaty that, among other things, is designed to address international child custody and protect children who have been abducted by a parent. This is accomplished by having an international procedure put in place that should allow children a relatively prompt return to their country of residence.
