"Some common mistakes I see during legal proceedings involving social media is number one, people continue to make posts on social media, which is never a good idea during your legal matter.
Can social media be used in your divorce case? Absolutely.
Social media comes up a lot in cases involving children or spousal support. It can be used to show what you are doing with your time, who you’re spending your time with. It can show posts that you made that you wouldn’t necessarily want to share with a court of law. It can affect you negatively where your ex-spouse is using a photo that you posted of you drinking or doing drugs with your friends on the weekend and using it as an argument for why you shouldn’t have custody over your children.
These posts, they carry a history with them. And whether you realize it or not, a history of what you post provides a lot of information as to your spending habits and what kind of money you have as well, which is obviously a crucial factor to determine when looking at issues of spousal support.
Another very common mistake that we see is people posting things which could fairly be described as some sort of hate message in regard to their spouse or their soon-to-be ex-spouse. And these posts can touch on the edge of defamation, but a lot of times it’s just not going to look good when that hateful message is brought up in court and used against you."
