Alimony (often referred to as “spousal support”) is a legal obligation for one person to provide financial support to a spouse (or former spouse) before or after a separation or divorce. Not everyone is required to pay or receive alimony, and that’s why it’s important to talk to an attorney if you’re in the process of legal separation or are getting a divorce.

California family laws are confusing when it comes to alimony or spousal support and maintenance after you get divorced. The various types of alimony are divided into several categories, generally determined by the length of your marriage and the roles the spouses played to financially support each other during the marriage. If alimony will be considered in your divorce settlement, your attorney will be responsible for fighting for an equitable arrangement, based on a variety of financial and lifestyle factors.

Types of California Alimony Support

In general, there are two types of alimony that can be awarded in California: Permanent and Temporary alimony. Permanent alimony support deals with the financial support that will be received when the divorce is finalized and going forward. Temporary support is designed to maintain the status quo (as much as possible) during the divorce process. Both are critical to the needs and abilities of the parties and both must be given careful consideration.

When determining alimony, the judge will consider factors such as:

  • Earning capacity of both parties
  • Marketable skills of the party seeking alimony
  • Accustomed standard of living
  • Future earning capacity caused by periods of unemployment
  • Contributions made toward the education of the supporting party
  • Debts and financial assets of both parties
