The Hague Convention and International Custody Disputes
When a parent moves out of the country with a child before a custody and visitation order has been entered or in violation of a court order, it is considered international child abduction. These cases can be a nightmare for parents as they can quickly become legally complex. If the country to which the parent has fled has signed the Hague Convention on the Civil Aspects of International Child Abduction, then the law becomes a tad easier to negotiate. At Feinberg & Waller, APC, our attorneys are skilled in international law as well as the provisions of the Hague Convention.
What if my child has been taken out of state or out of the country?
Child Custody Under the Hague Convention
The Hague Convention is a treaty that, among other things, is designed to protect children who have been abducted by a parent. This is accomplished by having an international procedure put in place that should allow children a relatively prompt return to their country of residence. Currently, over 70 countries have signed the treaty and include:
- United Kingdom
- United States
Our skilled California child custody attorneys are well-versed in the provisions of the treaty. International law adds some complexity to abduction cases, but you can rest assured that our lawyers have the skill and knowledge to provide diligent representation for your case.
International Custody Disputes Not Governed By The Treaty
If your child has been taken to a country that has not signed the treaty, things can get complicated, particularly if it is a country where women do not have legal rights. At Feinberg & Waller, APC, our lawyers are capable of handling the most complex child custody matters. We will work with legal counsel around the world to help resolve your dispute as safely and efficiently as possible.
